When Do I Get the Keys to My New Home?

In most Texas transactions, you get the keys on closing day -- but only after the deed has been recorded with the county clerk and the funds have been disbursed. In most cases, this happens the same day as your signing appointment, but in some situations (especially late afternoon closings), recording and funding may happen the next business day. Your agent and title company will confirm the timeline for your specific closing.

The Standard Texas Closing Timeline

Here is how a typical Texas closing day unfolds when it comes to getting your keys:

  • Morning/early afternoon: You sign all closing documents and provide your funds (down payment and closing costs).
  • Title company submits the deed for recording with the county clerk.
  • County clerk records the deed (usually same day if submitted early enough).
  • Title company confirms recording and funds are disbursed to the seller.
  • You receive the keys.

That last step is the one everyone is waiting for. But the timing depends on how quickly each step before it gets completed.

Same-Day vs Next-Day Keys

Whether you get keys the same day or the next day comes down to one thing: when the deed gets recorded.

Same-day keys: If you close before 3-4 PM and the county records the deed the same afternoon, you get your keys that day. Most title companies work with county recording offices that process deeds electronically, and same-day recording is common for morning and early afternoon closings.

Next-day keys: If you close late in the afternoon or on a day when recording is delayed (some smaller counties have limited hours), the deed may not record until the next business day. In that case, keys are released the next morning after recording is confirmed and funds are disbursed.

This is not a problem -- it is just how the process works. Your agent and title company will tell you before you sign what the expected timeline is, so there are no surprises.

What Determines When You Get Keys

Several factors influence the exact moment you take possession:

  • County recording office hours and processing speed. Larger counties like Bexar County typically have faster electronic recording. Smaller counties may have limited hours or slower turnaround.
  • Title company disbursement timing. Some title companies release keys as soon as the deed is submitted for recording; others wait until recording is confirmed.
  • Whether the seller has moved out. If the seller is still moving possessions out on closing day, keys may not be available until the home is fully vacated.
  • Rent-back agreements. If the seller is staying after closing under a rent-back, you will not get possession until the agreement ends.

Rent-Back Agreements

Sometimes the seller needs to stay in the home after closing. This is common when the seller is waiting for their own new home to close or needs extra time to move out. A rent-back agreement (also called a post-occupancy agreement) allows the seller to remain in the home for a set period -- typically a few days to 60 days -- while paying rent to you.

With a rent-back agreement, you legally own the home, but the seller stays as a tenant. You will not receive the keys or take possession until the rent-back period ends and the seller vacates. These agreements should clearly spell out the terms: how long the seller stays, how much they pay, who covers utilities, and what happens if they do not leave on time.

If you need to move in right away, make sure your offer does not include a rent-back or that the rent-back period is very short.

Tips for Closing Day

A smooth closing day means keys in hand sooner. Here is how to set yourself up for success:

  • Schedule closing for the morning if possible. An early signing gives the title company and county clerk time to record the deed and disburse funds the same day.
  • Confirm key pickup time with your agent before you sign. Know exactly when and where to collect your keys so you can plan your move-in.
  • Bring your phone for photos and celebrations. This is a big moment -- document it.
  • Have a moving plan ready if you are getting keys the same day. Coordinate movers, utilities, and cleaning crews so you are ready to go as soon as the keys are in your hand.
